Sue Roberds, Planning Manager Subject: Minor Deviation— 1709 West 5th Street Liam A minor deviation of the maximum 30% lot coverage in the RS-7 Residential Single Family Residential zone is hereby approved to 33% (2311 sq.ft.) This action is supported by the following findings and conclusions Findings. J 1 Per Section 17 94 180 of the Port Angeles Municipal Code, a minor deviation from O development standards may be approved by the Director of Community and Economic Development under certain circumstances. Minor Deviations of the Port Angeles Municipal Code require that findings be made such that: 1 The granting of the minor deviation is consistent with the purpose of the zone in which the property is located and the project is otherwise consistent with the requirements of said zone. 2. Because of special circumstance, the strict application of the zoning ordinance results in an undue hardship upon the applicant. 101 3 The minor deviation will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and zone in which the subject property is located, and 4 The minor deviation is not greater than 10% of the requirement being deviated from. 5 The site has been posted and adjacent property owners notified fifteen (15) days prior to approval of the minor deviation. Minor deviations not granted administratively must obtain a variance through the City's normal variance procedure as set forth in Chapter 2.52 PAMC Minor deviations may only be administratively approved up to a 10% deviation. 2. On August 18, 2010, Jeff Liang, on behalf of his parent QiZhu Liang, owner of 1709 West 5t' Street, requested a minor deviation of the maximum lot coverage in the RS-7 Residential Single Family zone to allow a 440 sq.ft. carport to be constructed on said property h Liang Minor Deviation—10-02 August3l 2010 3 Site development contains a large single family residence without a garage or carport. A shed will be removed to allow for construction of an approximately 440 sq.ft. carport at the rear of the site A garage/carport is considered a normal accessory use in the RS-7 zone. The current property owners did not construct the residence but wish to provide a carport to protect their investment in a family vehicle 4 Neighborhood development is single family residential with all homes with the exception of the subject home within the block containing either attached or detached garage and other accessory structures. The subject structure does not include area that was previously a garage and later enclosed. The development did not include the amenity at development or since. 5 Property owner QiZhu Liang personally notified property owners immediately adjacent to the subject address of the proposed minor deviation. Written confirmation was submitted indicating that three of the four abutting property owners notified had no issue with the proposal. One of the abutting residences is owned by an absentee property owner and is vacant. A letter was sent to the property owner of record with no response. Conclusions. 1 The minor deviation is consistent with the purpose of the zone in which the property is located and permits a small carport which is an expected use right for single family development. A carport not only protects a vehicle investment but is in the public interest as it provides a location for off street storage of a personal vehicle. 2. Adjacent neighbors were notified per Section 17.94 180 PAMC and did not object to the proposed increase in lot coverage. Neighborhood development will not be negatively impacted by the proposal.
