I would agree it does not fall into the minor repairs category, however, per 17.95.030 (A) it does not result in an increase in the degree of nonconformance. Based on my interpretation the addition fully conforms with setbacks and the rafters are simply a replacement of what exists (in design B they are at a different pitch). I also think it is important to emphasize that the applicant has gone out of their way to achieve full conformance with code including multiple design renditions at the request of the City. I am satisfied that their project fulfills the intent of code. Please proceed with processing the permit.
