Planning Director AMENDMENT TO CONDITIONAL USE PERMIT - CUP 94(11)10 JAMES - 1203 Past Seventh Street - "KLAHANE BED AND BREAKFAST" The request to EXTEND an approved conditional use permit (CUP 94( 11) 1 0) to allow the operation ofa four bedroom bed and breakfast in the RS-7, Residential Single Family zone is hereby approved subject to the following conditions: Conditions: I. Approval is fOf as long as the residence is operated as a bed and breakfast by the current residents/Owncrs, Mr. and Mrs. AI James. ~.; 2. .'! '.;~ , ,~ 1 The use shall continue to comply with all local and state development regulations, particularly Section 17.18 (Bed and Breakfast) of the Port Angeles Municipal Code with inspections as required by the City's .Fire Department. " .. .~~ 5. Smoke alarms are required in each bedroom and in the hallways adjacent to the guest bedrooms. This decision is made based on the following findings and conclusions: Findings: I. A conditional use pennit was approved on November 8, ! 994, for the applicant to operate a two (2) bedroom bed and breakfast at 1203 East Seventh Street., Due to a lapse in .. ( Admirr.'i!rntive Df'cision - James Extension - CUP 94(11) / 0 January 8. /998 Page 2 extension of the pennit, a new pennit was approved on January 8, 1996, for continued operation of the bed and breakfast as originally approved. 2. An amendment was approved, to allow an increase to a total of four (4) bedrooms for the bed and breakfast use on November 27, 1996. 3. Section 17.18 (Bed and Breakfast) of the Port Angeles Municipal Code (P AMC), and Ordinance No. 1709 (Zoning), as amended, allow for bed and breakfast uses in residential districts by conditional use pennit in the City. 4. Two neighboring property owners verbally expressed support ofthe proposed activity during the original pemdt hearing with the knowledge that this would be the second such activity in the neighborhood. Notification of the current extension request was mailed to property owners within 300 feet of the subject site, placed in the local newspaper, and posted on the site, as required by Section 17.96.140 PAMC on December II, 1997, identifying a public comment period until December 26, 1997. No comment was received. 5. A change in owership of the residence will require a new conditional use permit for continued operation. 6. Restrictions or conditions essential to protect the public health, safety and welfare, and to prevent depreciation of neighboring property may be imposed in approval of a pennit request. 7. All utilities, police, and fire protection are available and adequate for the proposed use. 8. Immediate revocation or suspension of the conditional use pennit may occur if the applicant violates or fails to meet any of the provisions of Chapter 17.18 P AMC. A copy of Chapter 17.18 PAMe was given to the applicant. 9. Scheduled hours of operation shall be seven days a week with check in time by 6 p.m. and check out time by II a.m. Alteration of the operation plan must be approved by the Planning Director. 10. Conditional use pennits are not transferrable to another location. II. No employees are required for the use. 12. The size of the residence and its location limit the nature of the operation and can be compatible in single-family zones. 13. The proposed use is consistent with the Residential Policies of the City's Comprehensive Plan. 14. An adoption of an existing environmental document (#602) was prepared on January 8, 1998, thereby satisfying the requirements of the State's Environmental Policy Act. That document was also determined to be satisfactory for the current amendment proposal. 16. All signs located within residential districts shall be no more than five (5) square feet in area, indirectly lighted, and parallel to the building facade to which they are attached unless they are free-standing in the yard. Free standing signs cannot exceed three (3) feet in height but may be perpendicular to the facade. The light source shall be shielded from abutting property and rights-of-way. There shall be a maximum of two free-standing signs. 17. The Fire Department has inspected the Structure and conditions may be imposed to assure continued compliance with Fire Department standards for the type of operation. 18. A second bed and breakfast (The Bavarian Inn) use is located in the same block. Conclusions.: A. As conditioned, the extension will not adversely affect the health, safety, morals or welfare of the surrounding neighborhood or public and is in the public interest. B. The proposal, as conditioned, complies with all requirements of the Section 17.18 (Bed and Breakfast Chapter) of the Port Angeles Municipal Code. C.
