Sue Roberds To: Ijenkins @jamestowntribe.org Date: 12/29/2008 4 40 PM Subject: 335 E. 12th Street CC Dear Leanne: Eric Walrath, Roger Vess; Steve Sperr Based on the site plan submitted by your contractor and revised on November 7 2008, I confirmed this afternoon with Public Works and Utilities, that your proposal to re orient a proposed garage structure north /south (facing the alley) from the proposed east/west orientation would resolve setback issues identified in past correspondence. The re orientation will result in the driveway being at least 25 of a marked or unmarked pedestrian crossing and /or 25' of intersecting right of way lines as is required per the City's Urban Services and Standards Guidelines (Curbed Street Driveway Location). Per Chapter 3 Transportation, of those same standards, the 'abandoned' driveway access shall be closed. This certainly doesn't preclude use of the rear of the site, just not through the depressed curb opening. To be sure we are all on the same page, please note the following issues in your final planning: 1 The interior (west) side setback shall be no less than 3' from the property line, with setback from the north property line (alley) no less than 10' 2. The driveway to the new structure shall be no less than 25' west of the side property line abutting Peabody Street. The curb cut from Peabody Street shall be removed and replaced to full curb height prior to final of the building permit. Please let me know if you have any questions about this information. Building permit, 335 E. 12 St. Dear Sue, Thank you for your letter dated December 8, 2008, outlining the rationale for discontinuing use of the driveway that served the parking area on the referenced property When I spoke with Steve Sperr on December 4, I assured him that I no longer contested this restriction and was prepared to submit a new site layout for the garage. However, I also told him that in order to revise my plans I needed a complete list of all the criteria I have to meet for the permit to be approved, and, since multiple city departments were involved, I thought a coordinated list of requirements should come from the permitting department. He said he would communicate that to the Building staff. As you may recall, I initially came into the Planning Department last Spring to discuss whether I would need a vanance to construct this garage. At that time you told me if I could locate ten feet from the alley and twelve feet from the power pole, a variance wouldn't be necessary Based upon that information, I decided it was do -able and chose not to pursue a variance from the setback requirements. The first plan we submitted met those setbacks, but the dnveway was an issue. We submitted an alternate plan showing access from the alley, then someone mentioned to my contractor at some point that something had to be sited 25 feet from the sidewalk. All of this permit- related communication from the City has been verbal with nothing spelled out in writing, which we know can lead to misinterpretation or confusion. Although your letter responded to my dnveway issue, as yet I still do not have a comprehensive list of the setbacks and standards I am required to meet and that is what I really need in order to move this project forward. For the fourteen years I have owned this property, I have used that driveway for left -turn ingress from Peabody Street to both the garage and the parking strip. I have never abandoned it or ceased to use it. In August of this year, in preparation for building a garage, I sold the red truck that I had parked on the site, but even on the last day I owned the truck, I used that driveway Except for the need to prepare the area for building, it would still be used and my intent has been to continue using it. A survey of dnveways on Peabody between Lauridsen Blvd. And 7 St. shows several similar driveways; some have obviously been improved, some are perhaps abandoned, and with some it is difficult to tell whether they are being used or not -only the property owner knows for sure. The final points I want to try to make with you are these: I want to build a simple garage to replace the one that I demolished and to access it in a similar manner, and I believe I have met the City's requirements.
