plan submittal requirements if you have questions.
VALUATION OF CONSTRUCTION: In all cases, a valuation amount must be entered by the applicant. This figure will be reviewed
and may be revised by the Building Division to comply with current fee schedules. Contact the Permit Coordinator at 417-4815 for assistance.
PLAN CHECK FEE: 1F a plan check fee is due it must be submitted at the time the building permit application and construction plans are
submitted. All other permit fees are due at the time of permit issuance.
EXPIRATION OF PLAN REVIEW: If no permit is issued within 180 days of the date of application, the application will expire. The
Building Official can extend the time for action by the applicant up to 180 days upon written request by the applicant (see Section 107.4 of
the Uniform Building Code, current edition). No application can be extended more than once.

Dear Mr. Dickson:
I represent Andy Swartzbacker and Catharine Reed. They own real property
located at the intersection of Willow Lane and McDougal Street in the City of Port
Angeles, as referenced above.
Enclosed is a diagram showing the location of my clients' property. The
traveled area south of their property is known as Willow Lane. Willow Lane
provides ingress and egress for the lots west of my clients. When Chambers
Addition was platted in May, 1890, what is now known as Willow Lane was
dedicated as Chambers Avenue. Chambers Avenue was not opened to the public
prior to 1895. As a result, Chambers Avenue was vacated by operation of the laws
of 1889 -1890 which provided:
"Any county road, or part thereof, which has heretofore been or may
hereafter be authorized, which remains unopened for public use for the
space of five years after the order is made or authority granted for opening
the same, shall be and the same is hereby vacated, and the authority for
building the same barred by lapse of time."

Upon vacation of Chambers Avenue by operation of statute, title to the
dedicated but unopened road reverted to adjoining landowners. Enclosed with this
letter is a copy of Gillis v. King County 42Wash2d 373, 255 P2d 546 (1953)
which discusses application of the statute. Also enclosed are certified statements
from Dennis Sawby and Bill Huizinga. Both statements support the conclusion
that Willow Lane was not made open for use prior to the 1950's. Trenia Funston
has provided a recorded document indicating that the south 30' feet of Willow
Lane was re- dedicated for public right -of -way in the 1960's. There is legal access
to my clients' property (from McDougal street) and the lots west of my clients.
Based upon this information, I request that the City of Port Angeles quit
claim to my clients its interest in the North half of Chambers Avenue adjacent to
lots 18, 19 and 20 in Block 3. My clients have not made an offer on lot 27 which
is to their immediate west.
I understand that you will be discussing this matter with the real estate
committee of the Port Angeles City Council. Please contact me if you wish to

CERTIFIED STATEMENT OF DENNIS SAWBY
I, DENNIS SAWBY, hereby declare and state as follows:
1. I reside at 841 Willow Avenue, Port Angeles, Clallam County, Washington.
I purchased my property in the 1940's. I built my home in the 1950's and have resided
there since the 1960's. I moved to Port Angeles at age 14. I worked at the Charles Nelson
mill on the waterfront in the 1920's. I had a variety of occupations after that, and have
retired. I am now 93 years of age.
2. I use Willow Avenue for accessto my residence. Attached to this
statement is a map, which shows my property on Lot 16 in Block 3 of the Ben Chambers
Addition to the City of Port Angeles. I understand that Andy Swartzbacker and Catharine
Reed own Lots 28, 29, and 30 in Block 3. Their property is at the east end of Willow
Avenue where it intersects McDougal Street.
3. When I bought my property in the 1940's, there was no access road public
or private. I discussed the need for road access to my property with a Mr. Collins, who
owned the acreage south of Lots 28, 29, and 30. Mr. Collins indicated that the fence on
the north side of his property marked his boundary with the right -of -way. The right -of-
way was undeveloped and was not open for use. Portions of Mr. Collins' fence, now
dilapidated, are still visible today. With Mr. Collins' knowledge and agreement, I
bulldozed a road to my property in what we thought was the right -of -way. I have used my
road (now called Willow Avenue) ever since. There is no other road access to my

property.
5. I understand that the Ben Chambers Addition plat named the right -of -way
as Chambers Avenue. The county decided that would lead to confusion because there
was already a Chambers Street in Port Angeles. My wife suggested "Quail Trail" for our
road. I liked her idea, but our neighbor did not agree, so we settled on the name "Willow
Avenue
6. When I purchased my property in the 1940's, the house and garage now
owned by Andy Swartzbacker and Catharine Reed were in the same location as they are
today. The road that I bulldozed past their property to mine was the first and only road
along Willow Avenue. It was apparent to me, based on my observations, that no roadway
or other public use or access had been made of the Chambers avenue right -of -way prior to
when I bulldozed the road into being. The right of way and property north of Mr. Collins'
property was undeveloped.

CERTIFIED STATEMENT OF BILL HUIZINGA
I, BILL HUIZINGA, am of majority age and am competent to testify to the matters
set forth in this declaration which are based upon my personal knowledge, information
and belief.:
1. I am employed as right -of -way agent for Clallam County, Washington. I
am responsible for maintaining records regarding public streets, avenues and rights-of-
way in Clallam County, Washington.
2. I was contacted by Dave Neupert, the attorney for Andrew Swartzbacker
and Catharine Reed, the owners of Lots 28, 29, and 30 ill Block 3 of the Ben Chambers
Addition to the City of Port Angeles as recorded in Volume 1 of Plats, page 97, records of
Clallam County, Washington. Attached to this statement is a map which depicts Block 3
of Ben Chambers Addition.
3. According to the Chambers Addition plat of May 26, 1890, the right -of-way
immediately south of Lots 28, 29 and 30 in Block 3 was designated as Chambers Avenue.
Based upon my review of the public records which pertain to this matter,1 have

determined that all of tIo 6, 11 and 14 of the Chambers Addition were vacated by
Clallam County on September 30, 1940, according to Commissioner's Record Volume
12, page 628. The South 30 feet of Chambers Avenue was vacated in that action.
4. 1 have reviewed the Clallam County public road index. According to the
index, Chambers Avenue in the Ben Chambers Addition was never opened to public use.
