Port Angeles Downtown Parking Association Dear Scott and Terry: While working with the planning department regarding the building permit for International Festivals Association it became evident that we should document the parking arrangements previously made for the increased occupancy at the Landing. As a matter of history, the parking spaces purchased through the PBIA by Waterfront Development Associates have been used for other purposes, (primarily the lease to the Heckman's) because of the lack of need generated by the Landing. As the occupancy at the Landing has increased the parking pressures increased. Therefore, it is our understanding the PA Downtown Parking Association has agreed to decrease the area formerly leased to the Heckman's by fifteen parking spaces beginning this year. The fifteen parking spaces will then be available for off -site parking through the PBIAICity of PA's parking program. We anticipate working with the PBIA in the future as increased occupancy creates further parking pressures If you agree that this is an accurate representation of the current working relationship between the Port and the PBIA please acknowledge below and return a copy of this letter for our files. The analysis of these parking counts raises three questions: Can the parking for vacant rentable area (1st 2nd Floors) be allocated to the parking required for new rentable area (3rd Floor)? 20 parking spaces for vacant rentable 17 parking spaces for new rentable +3 spaces Can the parking for vacant rentable area be allocated to the deficient parking later when that area is rented? 20 parking spaces for vacant rentable 18 parking spaces deficient +2 spaces Without verification of parking agreements/payments for off -site parking are the off -site parking spaces still provided for the Landing Mall? 40 spaces at Oak St. 40 spaces with PBIA 18 spaces deficient 98 spaces deficient The City is reluctant to hold up the International Festivals building permit until these questions can be answered for two reasons. First, it is not clear that anyone can answer the question regarding the parking spaces the Landing Mall has through the PBIA. Second, physically no more parking can be reasonably provided on -site, and, therefore, additional parking for the Landing Mall will have to be provided either through the PBIA or on other Port property (i.e., Oak St.). Moreover, the current parking space deficiency for the Landing Mall is on paper and may not exist with the current vacant rentable area. However, the Parking Ordinance is specific about requiring additional parking for new rentable area only, and, unless the Port agrees to provide all of the required parking spaces (201) through the PBIA (98) and on -site parking spaces (103), the City should not be approving new rentable area without meeting the Parking Ordinance. Landing Mall Parking Analysis January 3, 1997 Page 3 I believe, if the Port agrees to participate fully in the PBIA for all required parking spaces not provided on -site, then the building permit for International Festivals can be issued. The arrangements with the PBIA for this required parking need to be completed before certificates of occupancy are given to either the Attorney General or the International Festivals permits. The City Attorney has concurred with this form of agreement by the Port of Port Angeles for the Landing Mall. Please send me a letter of agreement if this meets with the approval of the Port. The agreement should have attached to it an off street (on -site) parking site plan and proof of participation in the PBIA as required by the City's Off Street Parking Ordinance, PAMC 14.40.170 (A) (B) (see attached copy of Chapter 14.40 PAMC). Box 1150 Port Angeles, WA 98362 -0251 Dear Brad: Thank you for your letter of January 3, 1996. The Port is in agreement to cooperate fully with the PBIA for required parking spaces not provided on -site at the Landing. We believe through our past participation in the PBIA that adequate parking has been provided for the Landing. It is our opinion that even with the increased occupancy on the third floor that no parking deficiency exists at this time. Future increases in occupancy may create a deficiency which we are confident we can resolve through the PBIA, much as we have dealt with the recent increased parking needs. As you point out in your letter the perceived deficiency is "on paper," and we will continue to communicate with the PBIA to provide real parking based upon real need. For the record, it is the Port's position that the third floor office space is not new rentable space nor is it a different use than previously planned. The initial development plans of Waterfront Associates included provisions for office users. The Landing was issued a certificate of occupancy for the entire building, including the third floor when development of the facility was completed with no additional parking requirements other than the forty spaces purchased from the PBIA at the time. Several years ago when the Port permitted with the City the renovation of the third floor the plan was not perceived as a new or different use. Dr. David Johnston subsequently leased office space and completed tenant improvements which were permitted through the City with no perception of a new or changed use. A building permit was very recently issued for the Attorney General construction project without this item being raised. Hopefully, our most recent efforts will help clarify the parking situation for the Landing if the issue is raised in the future. Therefore, we request that any current or future permits or certificates of occupancy for the Port not be delayed or denied based upon the actions of a third party (the PBIA). The Port proposes that the permit for International Festivals not be further delayed pending receipt by the City of an off street parking site plan and proof of participation in the PBIA, because we cannot guarantee the PBIA's timely response to the Port. We are hopeful our agreement to fully participate and to timely document our continuing efforts with the PBIA regarding off -site parking will be sufficient to issue the building permit for International Festivals Association which has been pending since December 5, 1996. Business (Offices) Chapters 26 27 April 22, 1991 TO: Cassie Maass, Landing Mall FROM: Jean Fairchild, Chairman Port Angeles Downtown Association Parking Committee RE: February 1991 Terry Roth Letter Dear Cassie: Sorry for the delay but I have been very busy and did not get my research done in order to answer Mr. Roth's letter you gave to the Parking Committee. I have enclosed a copy of Mr. Roth's letter. I did not feel the tone of Mr. Roth's letter was necessary. I think part of the problem is that many tenants in the Landing Mall do not understand the City Parking Code or how parking works in the downtown parking lots. Mr. Roth states that "the Waterfront Associations paid a penalty assessment to the P.B.I.A. for parking when the building was built." We did not have the P.B.I.A. when the building was built. When the Landing Mall was built the parking code required 232 parking spaces. On September 23, 1983 a meeting was held between Mr. Bob Love (Downtown Association), Mr. Pat Downie (Landing Mall), Mr. Paul Carr and Mr. Dave Floodstrom (City) to try and solve Landing Mall's parking problem. They agreed on 190 spaces, which the Landing felt they needed, not what was required. It was stated, at that time, that with pending architectural changes there would be 125 spaces on -site. There may have been 125 spaces when Landing received Occcupancy Permit, however, there are 108 spaces on -site at this time. On October 17, 1985 Mr. Dave Flodstrom and Mr. Jim Going agreed on the amount $8,236.00, which the Waterfront Associates would pay to the Downtown Association. This money is not for designated parking spaces for we share parking in downtown. The money is put into a special account to be used to upgrade lots, lease new lots or buy more lots. I do not think Mr. Going felt the $8,236.00 paid for 82 parking spaces was a penalty when it cost at least 2,000.00 to build a space at that time. page two April 22, 1991 I believe at the time all this happened, the people who were involved with the management of the Landing Mall were well aware that any more development at the Mall would require more parking. I have enclosed copies of letters which I hope will help you understand and thus explain to Mr. Roth what took place in the beginning. In researching Victoria Rapid Transits Building Permit denial in June of 1990, I found it was because they were required to meet their parking needs (40 spaces). I talked to Mr. Joe Schmitt as did the City, well in advance of the June date so I'm sure he was well aware of the need. Their permit was granted July 2, 1990. On June 29, 1990 Mr. Schmitt (V.R.T.) and Mr. Clarence Fidler (Port Angeles /Victoria Parking) entered into an agreement whereas Mr. Fidler would give V.R.T. the right to use 40 spaces on the west side of the paved parking lot situated west of Oak Street between Front Street and Railroad. This site is not located across from Mr. Fidler's office. The agreement was for a six month period from June 29, 1990 to December 28, 1990 for a sum of $1,500.00. I believe the management of Victoria Rapid Transit is well aware of this agreement and thus are aware they need to renew this agreement, find other land to build 40 parking spaces or pay the Downtown Association (Managers of P.B.I.A.) their parking assessment. Cassie, there are seven parking lots in downtown area which are managed by the (PBIA) Downtown Association. They are numbered 1 -7. I have enclosed a map showing their locations. None of these lots can have designated parking spots for any one business. Over the years people have given them names mainly to identify location when discussing them. Lot #2 is referred to as the Coho lot. Coho Management, Mr. Barrett, has asked that it not be referred to as that because it certainly is not their parking lot. The Coho developed its own parking several years ago. Lot #2 has 96 parking spots. It has 49 two -hour spaces and 47 all day spaces which are leased to Budget Parking to manage on a yearly basis, for a fee which Budget pays to the Downtown Association. This issue will again come up, as the use allowed was "cond- itional", for 1990 only. Any delays, additional parking costs, etc., will cause the filing of a law suit against PBIA, officers and members, if for any reason current, prospective or future tenants are denied access to the lot across from the Landing. The Waterfront Associates paid a penalty assessment to the PBIA for parking when the building was built. The lot leased to Budget was "in excess to current needs I suggest you express our concerns to the PBIA at your earl- iest opportunity, so that they can avoid a civil suit. I think that the discussion to have a "thank you" part just prior to your grand opening is a good idea. Also the mid -July dates also seem appropriate. During our meeting, you asked if I could again give you the infor_•- mation on the parking assessment fee which The Landing owes Lo the Downtown Association. I have attached a copy of my previous calculations for your reference. As can be seen, the amount of $8,236 is owed prior to, or at the time of, an "Occupancy Permit" being issued by the City. T'hi amount needs to be paid to the Downtown Association (Attentions Dennis Holman, Chairman of the Parking Committee at First Federal). The Downtown Association will notify the City of payment and we can proceed with permit issuance (assumi;ng all other occupancy concerns are resolved). Again, the project looks great.
