HomeMy WebLinkAbout106 W 7th St - BuildingDECISION Conditions. pORT NGELES W A S H I N G T O N U S A DEPARTMENT OF COMMUNITY ECONOMIC DEVELOPMENT DATE August 18 2008 APPLICANTS Susan Marvin Witherow FILE HOP 08 -02 LOCATIO 106 W 7 Street REQUEST A beauty salon in an accessory structure in the RHD, Residential High Density zone as a Home Occupation Home Occupation Permit HOP 08 -02 is hereby approved subject to the following conditions, findings, and conclusions as follows. 1 The permit is specifically issued to Susan Witherow to conduct a personal service beauty salon from a detached accessory structure at her residence, 106 W 7th Street. 2 Business hours will be restricted to between 9 00 a.m. and 5 p.m., Monday through Friday 3 Four (4) off street parking spaces shall be available on site during business hours two (2) for the residence and two (2) for client use only Parking spaces shall be identified and marked on the site as shown on the site plan submitted on August 5, 2008, as approved by the Public Works and Utilities Department. 4 Ingress/ egress to the structure in which the home occupation will take place shall be redesigned and developed in accordance with the International Building Code (IBC), specifically Section 1024- Exit Discharge. 5 All aspects of the business shall be conducted in conformance with the Home Occupations Permit Chapter (17 17) of the Port Angeles Municipal Code 6 The initial time limit approval for home occupation activities shall not exceed one year and will expire August 18, 2009, after which time extensions may be granted as provided in Chapter 17 17.210 of the Port Angeles Municipal Code Extension must be requested prior to August 18, 2009, if extension is desired. HOP 08 -02 Witherow Page 2 August 18, 2008 This decision is made based upon the following findings and conclusions Findings. 1 The applicant applied for a Home Occupation Permit to conduct a beauty salon in the RHD, Residential High Density zone at 106 W 7 Street. The proposal is to conduct the use in an existing, to be converted, detached garage. 2 The applicant proposed business hours of between 9 00 am and 5 00 pm, Monday through Friday Section 17 17 040(C) (Home Occupation Chapter) of the Port Angeles Municipal Code (PAMC) indicates that hours of operation may be from 9 a.m. to 5 p.m., unless otherwise specified by the Director of the Department of Community and Economic Development. 3 Publication appeared in the Peninsula Daily News, on July 21, 2008, with notices mailed to surrounding property owners within 300 feet of the proposed location, and the site posted by staff on July 24, 2008 Public comment was accepted until August 5, 2008 No comments were received from the public 4 The use is a single person operation. No employees are anticipated. 5 Per Section 17 17 040 PAMC, there shall be no exterior display, no exterior sign, no exterior storage of materials, and no other outward appearance of a business that would detract from the residential character of the area. 6 The Department of Community Economic Development will forward official action concerning the permit decision to the Public Works and Utilities Department for a determination of utility charges. 7 Failure to comply with the Home Occupation regulations may result in revocation of the permit (Section 17 17.300 PAMC) and shall prevent further extension of such permit (Section 17 96 070(F)) 8 Per Section 17 17 040(G) of the PAMC, Home Occupations shall be conducted in whole or in part in the dwelling unit but not in an accessory building unless specified by the Director of Community and Economic Development; provided that the dwelling unit and accessory building in which the Home Occupation is conducted shall occur on the same parcel. 9 Goals and policies of the City's Comprehensive Plan that support and encourage home occupation activities include Land Use Map, Goals, Policies. and Obiectives Goal A. `To guide current and future development within the City in a manner that provides certainty to its citizens about future land use and the flexibility necessary to meet the challenges and opportunities of the future" Goal A, Policy A.1 All land use decisions and approvals made by the City Council and /or any of its appointed Commissions, Boards or Committees should be consistent with the Comprehensive Plan and its land use map Residential Goals, Policies, and Obiectives Goal C `To have a community of viable districts and neighborhoods with variety of residential opportunities for personal interaction, fulfillment, and enjoyment, that are attractive to people of all ages, characteristics and interests HOP 08 -02 Witherow Page 3 ugust 18 2008 Goal C Policy C 1 `Residential land should be developed on the district and neighborhood concept. Although such districts may be composed primarily of residential uses of a uniform density a healthy, viable district should be composed of residential uses of varying densities, which may be augmented, by subordinate and compatible uses Single family and multi- family homes, parks and open- spaces, schools, churches, daycare and residential services, home occupations, and district shopping areas are all legitimate components of district development and enhancement. A neighborhood should be pnmarily composed of low, medium, or high density housing. 10 A Determination of Non Significance was issued on August 6, 2008 This action satisfies the City's requirements for environmental review 11 Home Occupation Permits may not be transferred to another location or to another operator 12 The initial time limit for home occupation activities shall not exceed one year, after which time extensions may be granted as provided in Chapter 17 17.210 PAMC Extensions may be allowed for one to five year periods and must be requested by the applicant prior to extension of the permit. 13 The City's Zoning Ordinance, Section 17 17 040(H) requires the Director of the Department of Community and Economic Development to determine off street parking requirements for home occupation activities based on the proposal. All residential uses in the City are required to provide a minimum of two (2) off street parking spaces for the residential use per PAMC 14 40 That ordinance also indicates that parking area improvements shall be determined by the City Engineer and completed within two (2) years of the date of approval. The subject property site plan identifies a driveway with capacity for two (2) cars and an off street parking area located in the rear of the property with a capacity for an additional two (2) cars for the Home Occupation. The dnveway is accessed only from 7 Street. The rear parking area is accessed only from the 7 /8 Street Alley A site inspection indicated that driveway improvements off 7 Street have been completed and approved by the Public Works and Utilities Department. 14 The site plan submitted shows the main entryway into the detached structure at the south end of that building perpendicular to a proposed parking space off the 7 /8 Alley Less than ten feet of space exists between the building and the south property line. A second parking space is planned east of the detached home occupation proposed structure. Conclusions. A. Uses immediately south of the site are zoned and developed as commercial. As conditioned, use of the detached structure for the proposed home occupation will not negatively impact surrounding uses or properties. The extraordinary (not in the primary structure) use will not enable the use of equipment or processes that introduce noise, dust, fumes, vibrations, odors, and other hazards in excess of those normally found in residential areas or otherwise used in such a use if the activity were to be restricted to within the pnmary residence Additionally, proximity of the proposed detached structure nearer to the alley than is permitted for a primary residential will allow screening of the activity from other residential uses along Seventh Street causing the activity to only be recognized from the rear, adjacent to commercial uses developed along the alley south of the site. HOP 0.4 .2 Witherow I we 4 August 18 260 B Entrance to the proposed building shall be developed in accordance with Section 1024 6 of the International Building Code (Exit Discharge) that requires a specific unobstructed path of travel from and between structures C As conditioned, the home occupation will not significantly increase local vehicular or pedestrian traffic, will not interfere with the expected or existing use of the alley, and will provide sufficient off street parking for the proposed use and residential use An added bonus is that the required (new) driveway access will provide relief to the on street residential parking impact that has existed prior to the current dnveway access. D As conditioned, there will be no outward appearance of anything but a residential activity taking place at the residence, and therefore, the activity will not be injurious or detrimental to adjoining or abutting properties. E. The home occupation as conditioned will not endanger the public health, safety, or welfare The proposal is in compliance with goals and policies contained within the City's Comprehensive Plan to enable a diversity of uses within residential zones that serve a public interest. F As conditioned, the use is in compliance with development standards of the Port Angeles Municipal Code (PAMC), and more specifically with Sections 17 17 (Home Occupation Permit), and 14 40 (Parking Ordinance) G The proposed parking configuration does not allow adequate separation between the building entrance and parking area. Conversations with the owner identified that the entryway could be placed east of the proposed structure. As conditioned, sufficient access for parking and an unobstructed area for an acceptable entrance to the structure can be designed, and are required, such that the development will be in compliance with the International Building Code 71(,?r-2/2AL/)_.
