A portion of his property is within the City limits and a portion in the county. The house sits in the county portion. Back in 2005 he requested water service from the City. After much discussion it was determined that the City could serve him but the rate for the water service would be at the outside rate because the residence receiving service was physically located outside the City. He was not required to have solid waste service. He is now asking to be considered inside the city limits so he could pay inside rates. Question. Should we continue to consider him as an out of city limits customer? Or if we considered him as an inside city customer for water service then shouldn't he pay for solid waste also? I have attached a picture showing his property and the city limit line. You help is much appreciated. Having said that, I seem to remember telling him several years ago that if his house - which is the residence receiving service - is physically located outside the City, then that is what determines that he has to pay 150% of City rates, per PAMC. >>> Trenia Funston 1/30/2008 12:33 PM >>> Steve, Do you want to make the call on this one? He agrees but claims that half of his property is inside city limits, so he should be allowed to pay inside water rates instead of outside. Can you verify this? Our ordinance, 13.22.040, addresses water service outside the city limits. In this case, the service is outside. So, the customer pays the outside rate, 2. Our ordinance does not expressly address a situation where property is half in and half out. Where a situation is not expressly covered, the Directors of Finance and of PW&U are authorized to promulgate policies and rules as they deem appropriate, 13,28,100, If they want, they could made a policy that, in a half/ half situation, a customer can be treated as a city resident if he signs up for all city utilities, or something along those lines. So, continue to treat the customer as outside the city, until and unless the two Directors agree to a different treatment for the half / half situation, Call if you want to discuss this further.
