A. � v Community & Economic Development Department January 23,2014 - Mr. Mike Caudill 1329 W. 106 Street Port Angeles,WA 98362 RE: v226 East Second Street Dear Mike: This letter is in response to our discussion regarding the repair and construction of a secondary access stairway that was constructed within a required side yard and above the first floor of a structure at 226 East Second Street. Review of the situation revealed that not only is the secondary access constructed significantly within the sideyard setback,it is not constructed to Building Code standards. Although the Port Angeles Municipal Code allows some relief from setback requirements in cases where all other alternatives have been exhausted, that relief is minor and may only result in a 10%deviation. The stairs appear to be approximately 3 feet from the east property line. The standard sideyard setback for the property is a minimum 7 foot setback. There is no deviation permitted from Building Code standards for this type of structure. At this point I cannot offer you an easy resolution. Because the stairway has not been constructed to Building Code standards, I must direct you to obtain the required building permit and begin reconstruction immediately. Because the City has been apprised of the situation,this repair cannot be delayed. The steps are a secondary exit with alternative access via an elevator. However,the secondary exit is required for safety purposes and most be repaired/reconstructed to Code. I greatly appreciate your honest and committed attitude to address and rectify this situation is appreciated and we look forward to your bringing this situation into compliance immediately. Prior to any construction activity,the applicant shall obtain a building permit from the City of Port Angeles. 2. Drainage from new impervious surfaces shall be directed to existing stormwater structures and no stormwater shall be directed over the marine bluff. Findings: 1. An application for review under Chapter 15.20 PAMC (Environmentally Sensitive Areas) was received on June 15, 2004, from Aawnings and Sunrooms of Distinction for the construction of a glass enclosure of an existing upper story deck. 2. The subject property is located at 226 W. 2"d, and the building is located within-the 50-foot required buffer for a marine bluff. ESA 04-06-Hawksworth Page 2 3. The buffer area meets the criteria listed in PAMC 15.20.080.3 of being a previously altered environmentally sensitive area. 4. The subject site is zoned RHD, Residential High Density,with a strip along the north side, zoned PBP, Public Buildings and Parks. 5. A June 9,2004 letter from Zenovic and Associates was submitted with the application. The letter states that the proposed construction will apply minimum loads on the structure's foundation and the construction will not result in a negative impact to the stability of the bluff. 6. Portions of the subject property meets the definitions of an environmentally sensitive area as defined by PAMC 15.20 (Environmentally Sensitive Areas Ordinance). The purpose of the Chapter is to protect environmentally sensitive areas in accordance with the Growth Management Act. The intent of the Chapter is to use a function and values approach and establish minimum standards for properties containing environmentally sensitive features in order to protect the public health,safety and welfare which includes: a)avoiding disturbance of these areas,b)mitigating such impacts,c)protecting the public from personal injury,loss of life or property damage due to erosion and landslides, etc., and d) protecting against publicly financed expenditures from misuse of environmentally sensitive areas. 7. All development proposals in environmentally sensitive areas shall comply with the requirements and provisions of Chapter 15.20 PAMC. The responsibility for administration and enforcement of the provisions of the Chapter shall rest with the Community Development Director or his designee. 8. The application included an environmental checklist as required under RCW 43.21C and PAMC 15.04. Location: 226 West Second Street. Mr. Miller reviewed the Department Report. chairman Barnhart opened the public hearing. Craig Miller, attorney representing the applicants, explained that the proposed new setback was an agreed-to stipulation between the applicants and the Fisher-Hales who had filed a lawsuit. Chairman Barnhart closed the public hearing. Mr. Lewis moved to amend the variance to increase the established front yard setback from 5 feet to 15 feet feet, citing the following finding: That the proposed 15-foot setback is closer to compliance with the required minimum 25-foot front yard setback of the RMF, Residential Multi-Family District in which the property is located. Mr. Lacey seconded the motion, which passed unanimously. At this stage our review indicates the following issues should be resolved prior to construction: 1. The size of the structures must be reduced because the lot coverage exceeds the 35% maximum permitted by (V 87(5)11) according to our calculations of submitted plans. 2 . The height of the building must be reduced because the main roofline exceeds the maximum 35 ' height by approximately 2 ' . Please note however, that the excess height may exceed 2 ' as the plans received by the Public Works Department on July 13, 1987, provide inadequate information; i.e. , there is no height given on the north side. The elevator shaft roof which is permitted to be 40' in height by Variance V 87( 5)11, appears to meet Code. 3. The roof overhangs on the two carports are too close to the property line per Uniform Building Code requirements. 4 . As of today, the comments of the July 2, 1987 ICBG letter have been satisfied; however, please note that you will also need to satisfy the requirements of the July 10th ICBO letter. Said hearing 19 resulted in the granting of the defendant Montgomery' s variance 20 request. As of the date of this: affidavit, however, no written 21 order or decision has been entered. 22 23 5. Attached hereto as Exhibit B is a copy of a May 6, 24 1987, letter to the plaintiff, Madeline Fisher-Hales, from the 25 City of Port Angeles, Planning Department, setting forth the fin- 26 27 dings of the Board of Adjustment with respect to said variance. 28 This is the only document known to plaintiffs which purports to 29 set forth in writing the 30 findings of the Board of Adjustment with 31 AFF. The Board of Adjustment 10 7 J granted the defendants 11 Montgomery a variance from the zoning codes and ordinances of the c 12 City of Port Angeles in three areas: (a) a variance from the 12 0 n 15 variance from the Code front yard set-back requirement of 25 x 16 feet to 5 feet; and g m (c) a variance from the Code building 17 18 height requirement from 35 feet to 40 feet. m z 19 8. Location: 226 West Second Street. Mr. Miller reviewed the Department Report, which recommended denial. Chairman Barnhart opened the public hearing. Wes Stout, 227 West Third Street, supports the variance so that something will be built on the property to replace the existing structure. Tim Haley, architect, representing Mr. Montgomery, explained that since the original submittal of the variance applica- tion, they have made a number of reductions: Lot coverage has been reduced from 628 to 358; roof angles were decreased so that now only the elevator shaft is above 35 feet. He noted that the carports represent 108 of that 358 lot coverage,. He noted that the existing bluff in the north portion of the property was too steep to construct Second Street which would have provided primary access. Byron Perkins, Sergeant Engineers, Seattle, explained that the existing bluff was approximately at its angle of repose or.? that the proposed footings for the building would occur `­s?.ow the angle of repose, which is proper. Steve Vinovic of Polaris Engineering explained that soils tests of the bluff revealed that no significant slippage is likely to occur because of the building. Jack Montgomery, applicant, submitted letters of support for the variance application, and explained that they would cut down the existing trees. Glen Smithson, 212 West Second Street, supports the project and felt that the additional traffic created by it would not be a problem. Mr. Montgomery explained that they would utilize a lot on Third Street for parking of the remaining 508 of the minimum parking requirement. Gus Haley, potential tenant, supports the project. Ed White, 222 West Second Street, supports the proposal because anything would be an improvement over the existing building. John Mair, a potential tenant, supports the proposal. To the immediate east of the property is a single-family dwelling; to the west is a single-family dwelling; to the south across the alleyway are single-family dwellings; and to the north of the property is a naturally vegetated bluff. 4. PROPERTY CHARACTERISTICS; The subject property is a 100 ' x 140 ' deep, 14,000 square- foot rectangular lot, oriented north/south. The block on which the property is located is generally level, except for the steep slope at the west end of the alley, and the bluff at the north end of the entire block. There is an existing single-family structure on the property, although it is r, apparently abandoned at this time. The vegetation earlier used for landscaping on the property is overgrown and the property is generally level with a slight slope to the north. Access to the property is from the south via the two-way traffic alleyway which runs east-west. Visibility to the east is good, although the alley is narrow with cars parked on the north side. Visibility to the west is impaired by the steep slope to the west, which allows a limited visual sight distance of approximately 60 feet. 5. DEPARTMENT EVALUATION: The Residential Multi-Family District within the Zoning Code allows for a maximum 30% lot coverage. The applicant has requested a variance to allow 35% lot coverage. In addition, ' ^e No. V-87 (5) 11 Department Report Page 3 the applicant has requested a variance on the 25-foot front yard setback to 5 feet, and a variance on the 35-foot maximum height requirement to 40 feet. The following are staff' s evaluation after reviewing the application and visiting the project site: 1. The property is a 100' x 1401 , 14,000 square-foot, rectangular lot which is essentially level, with a bluff to the north. While the bluff to the north could possibly be considered a special characteristic, in actuality, it is not a special characteristic that deprives the property of any use rights that any other RMF multi-family zoned property in the vicinity could utilize. This is because the slope is mild at the extreme north end of the property and the bluff begins within the public right-of-way. Further, although the parking facilities for this new seven-unit proposal are now detached, and as such, comply with zoning regula- tions, the 15-foot distance to the alley for seven of the fourteen required parking spaces for this proposal will not allow sufficient maneuvering room on the site and will require maneuvering of vehicles in the alley, which is contrary to City policy, a situation which is not caused by the bluff and/or special circumstances particular to this property. The City requires a 25-foot aisle for maneuvering off the right-of-way for 900 parking spaces. The need for this 25-foot minimum maneuvering area requirement is accentuated by the 60+ foot sight distance to the west for the proposal's required fourteen parking stalls, which will ingress and egress from the alleyway. 2. If the variance is granted, the applicant will be able to construct an additional 20 feet closer to the front File No. V-87 (5) 11^ Department Report Page 4 property line; to construct five feet above the re- quired maximum; and to exceed the maximum lot coverage by 5%. As this property is rectangular in shape and generally level, with no special circumstances related to the property which deprive it of privileges or use rights accorded other properties in the same vicinity and the same zone, granting the variance requested will bestow special privileges to this property. 3. The subject property is surrounded by single-family residences to the west, east and south across the alley. Accordingly, granting a variance on the 35-foot maximum height requirement to 40 feet, and for the 308 maximum lot coverage to 35%, could be detrimental to the surrounding properties because light and air circu- lation, plus view to the north, would be restricted to a greater degree than from the restrictions imposed by a proposal which is in compliance with the Zoning Regulations for the RMF Zone. The Department recommends denial of the variance application because the request does not comply with any of the three required criteria. The following findings are cited: A. The subject property is a rectangular, 100' x 1401 , 14,000 square-foot lot that is basically level and has no special characteristics that deprive the property of normal use rights associated with the RMF Residential Multi-Family zone when the requirements are imposed. B. The discussion started with Tim Haley giving an explanation of the project which will be a seven unit four story complex on two city lots for a total of ' 14,000 square feet plus the lot across the alley to be utilized for parking. The proponent has requested variances from the lot coverage, height restrictions and front yard setback. The height of the main structure is 35 feet with the elevator shaft rising to 40 feet. The front yard setback is requested to be within five foot of the platted unopened Second Street right-of-way. Lot coverage is 35% with carports. The seven unit building will have storage underneath and two units on each of the four levels with the exception of the top level which will have one unit. 2. The building official explained that under page 556 of the Uniform Building Code concerning exits required that the two spiral staircases shown are not permitted i as exterior stairways to be used as fire exits or second exits from the building. A discussion followed of second exit requirements and types of stairways that could be used. 3. Bruce Becker of the Fire Department questioned whether or not a two hour party wall was required for condo- miniums and it was determined that one hour construc- tion is required. Bruce also noted that the multi- family zone requires fire sprinklered for three or more units. A wet system residential type sprinklers can be used in this instance however it must be protected against freezing. Bruce also gave an explanations of the sprinklers requirements. 4. The building official noted that the elevator needs to be separated from the stairway and recommended turning the elevator. 5. Steve Hursh of the Light Department made mention that the electrical lines are required to have ten foot overhead clearance above the carport and could connect at the elevator shaft. He also noted that six or more units would require a main disconnect at the building and that there would be a separate meter for each unit and one for the elevator. For the type of conduit and materials, the proponents were advised to contact Mark Shamp, the City Electrical Inspector. 6. There was discussion on water and sewer services for the site. The proponents requested a 2j inch service size for water and also requested information on the use of cast iron plumbing pipe. �. N 7.
