HomeMy WebLinkAbout5.1007 Original ContractAnimal Transfer Agreement Olympic Animal Sanctuary EIN: 26-0886993 The following AGREEMENT is entered into by Olympic Animal Sanctuary, hereinafter referred to as 'the Sanctuary', and the City of Port Angeles Animal Control Authority, hereinafter referred to as 'the Client', on this 15th day of March, 2010. WHEREAS the Client has elected to transfer custody of one or more animals to the Sanctuary, NOW, THEREFORE, the Sanctuary and the Client hereby agree to the following: 1. The Client hereby releases all rights of ownership and transfer into the custody of the Sanctuary the animal(s) described herein (use additional pages if necessary): Animal 1: Name: Jack Species: Dog Breed: Lab Mix Color: Black and tan Sex (check one): _X_Male _Female _Unknown Age: Spayed/neutered: _Yes No Canines only: Has the animal been tested for heartworm? _Yes No If yes, the result was _Positive _Negative Is the animal currently receiving heartworm preventative? _Yes No Brand: The animal has resided in the vicinity of Port Angeles , WA for 2 months. City Stale Additional health concerns (all species): Unknown 2. The Sanctuary hereby accepts ownership of and full responsibility for the animal. 3. The Sanctuary shall provide the animal(s) with lifelong care, including appropriate food, shelter, exercise, veterinary care, conditioning, and socialization, so as to constitute a high quality of life. a. In the event that the Sanctuary is unable, due to financial crisis or other unforeseen circumstances, to provide the animal(s) with the care described herein, the Sanctuary will (check one): _attempt to restore custody of the animal(s) to the Client before seeking permanent placement for the animal(s) elsewhere. _X_seek permanent placement for the animal(s) elsewhere, at the Sanctuary's sole discretion. b. The animal(s) may be destroyed only as an act of euthanasia for the purpose of relieving suffering due to untreatable injury or illness, at the sole discretion of the Sanctuary. The animal(s) will not be destroyed for reasons relating to behavior, treatable injury or illness, or other inconvenience. 4. The Sanctuary shall provide the Client with reports of the animal(s)' physical and psychological health at the request of the Client, within a reasonable time from the receipt of the request. 5. The Client shall provide the Sanctuary with any history or information at its disposal pertaining to 5.1007 the animal(s), including veterinary records, incident reports, police reports, etc. 6. The animal(s) shall become the sole responsibility of the Sanctuary at such time as physical possession of the animal(s) is taken; prior to the physical transfer of custody, the animal(s) shall remain the legal responsibility of the Client. The Sanctuary shall not be liable for any incident(s) involving the animal(s) prior to the physical transfer of custody to the Sanctuary or its agent(s). The Client shall not be responsible for any incident(s) involving the animal(s) after the physical transfer of custody to the Sanctuary or its agent(s). 7. The transport of the animal(s) to the Sanctuary shall be the responsibility of (check one): _X_the Sanctuary the Client 8. The dog is currently in the custody of the Clallam County Humane Society. Jack has been declared a dangerous dog by the City of Port Angeles. 1 unconditionally surrender the above animal to the care and control of the City of Port Angeles. I understand that the City of Port Angeles may dispose of this animal by whatsoever means it deems advisable, including euthanasia (humane death). It is expressly agreed that the City of Port Angeles, including its officers and employees, will not incur any liability to me of such disposition of Jack. I release the City of Port Angeles from all liability for, and assume all responsibility for any and all damages of any nature whatsoever arising from my ownership or custodianship of Jack prior to my surrendering Jack to the City of Port Angeles.
