Duncan Yves McKiernan, (hereinafter "Contractor
For and in consideration of the mutual covenants and promises
contained herein, the parties agree as follows:
Section 1: Aareement by Contractor
Contractor hereby agrees that the bell sculpture that he
created for installation at the Port Angeles City Pier is the
exclusive property of the City of Port Angeles.
Section 2: Aareement by City of Port Angeles
The City of Port Angeles agrees to defend and hold the
contractor harmless from any personal injury or property damage
claims arising out of, or in any way connected with, the use of the
sculpture.
