Several parties, including the Chamber of Commerce and State Department of Natural Recourses have stated that due to the condition of the structure it would greatly improve the appearance of our water front if it 'went away' Dan and I have volunteered to have it removed, and will incur the expense. We are working to get as much of that reduced as possible, for it is 'out of pocket' for us. We have been working with the City Staff to get the necessary permits and procedures worked out, as the building will be removed by a contractor Vision Builders. It will be transported from the site to the city land fill. We are requesting from The City that the fees be waived, for we will have no monetary gain from this. It is just a community service with the objective of improvement in the look of our water front. I have been in contact with you and a number of the other City Staff and am not only receiving the information needed, but excellent cooperation and suggestions. Thanks for your help, and we look to having this completed in a few weeks. State reserves the right to revoke this license under the following circumstances (a) immediately upon material breach of any of the conditions herein or for reasonable cause, by the State's authorized representative without compensation to the Licensee or liability to State (b) upon thirty (30) days' written notice to Licensee in the event the State changes its plans for the site Form Date: 10/2003 1 Agreement No «Agreement Number» SECTION 4 AUTHORIZED ACTIVITIES (a) The activities authorized to be conducted are described in Exhibit B to this Agreement (the "Activities") No other activities may be conducted on the Property without the prior written permission of State Not included in this Agreement are any rights to harvest, collect, or damage any natural resource, including aquatic life or living plants. (b) Restrictions on Use Licensee shall not cause or permit any damage to natural resources on the Property, except to the extent such damage is expressly permitted under the mitigation plan incorporated in Exhibit B Licensee shall also not cause or permit any filling activity to occur on the Property This prohibition includes any deposit of rock, earth, ballast, refuse, garbage, waste matter (including chemical, biological or toxic wastes), hydrocarbons, any other pollutants, or other matter in or on the Property, except as approved in writing by State. Licensee shall neither commit nor allow waste to be committed to or on the Property If Licensee fails to comply with all or any of the restrictions in use set out in this Section 4, State may take any steps reasonably necessary to remedy such failure Upon demand by State, Licensee shall pay all costs of such remedial action, including but not limited to the costs of removing and disposing of any material deposited improperly on the Property (c) Environmental Liability/Risk Allocation (1) Definition. "Hazardous Substance" means any substance which now or in the future becomes regulated or defined under any federal, state, or local statute, ordinance, rule, regulation, or other law relating to human health, environmental protection, contamination or cleanup, including, but not limited to, the Comprehensive Environmental Response, Compensation and Liability Act of 1980 ("CERCLA"), 42 U S C '9601 et seq , and Washington's Model Toxics Control Act ("MTCA"), RCW 70 105D 010 et seq (2) Use of Hazardous Substances Licensee covenants and agrees that Hazardous Substances will not be used, stored, generated, processed, transported, handled, released, or disposed of in, on, under or above the License area, except in accordance with all applicable laws Licensee agrees to use hazardous substances only to the extent necessary to the permitted use under this License. (3) Notification and Reporting. (2) Prior to the termination of this Agreement, or within thirty (30) days after receiving notice of an early revocation of this License, Licensee shall restore the Property to a condition as described in Exhibit B except for any changed conditions caused solely by parties other than Licensee, its agents, contractors, or subcontractors. SECTION 5 TITLE TO PROPERTY State grants a right of access only to the extent of its interest in the Property It does not warrant that it is the owner of the Property or that Licensee's entry and use of the Property does not violate other persons rights to the Property Licensee agrees to obtain approvals from other persons who have a right, title, or interest in the Property This license shall not be exclusive and State may grant similar rights to anyone else. State may also lease the Property or grant easements or licenses Form Date: 10/2003 3 Agreement No. ((Agreement—Number)) SECTION 6 NOTICE OF DATE OF ENTRY Licensee and its agents, contractors, and subcontractors shall provide State with at least two (2) weeks notice of the schedule of anticipated dates necessary for conducting the Activities Licensee shall promptly notify State of any modifications in the schedule SECTION 7 COMPLIANCE WITH LAWS Licensee shall, at all times, keep current and comply with all conditions and terms of any permits, licenses, certificates, regulations, ordinances, statutes, and other government rules and regulations regarding the use of the Property Licensee shall, at its sole expense, obtain all regulatory or proprietary consents or approvals required to be obtained from any public authority State or third party in connection with any work on the Property or Licensee's use or occupation of the Property SECTION 8 INDEMNIFICATION AND LIABILITY Licensee shall indemnify, defend, and hold harmless State, its employees, officers, and agents from any and all liability, damages (including bodily injury, personal injury and damages to land, aquatic life, and other natural resources), expenses, causes of action, suits, claims, costs, fees (including attorneys' fees), .penalties, or judgments, of any nature whatsoever, arising out of the use, occupation, or control of the Property by Licensee, its subhcensees, invitees, agents, employees, licensees, or permittees, except as may arise solely out of the willful or negligent act of State or State's elected officials, employees, or agents To the extent that RCW 4.24 115 applies, Licensee shall not be required to indemnify, defend, and hold State harmless from State's sole or concurrent negligence SECTION 9 INSURANCE At its own expense, Licensee shall procure and maintain during the Term of this license, the insurance coverages and limits described in Section 9(a) and (b) below This insurance shall.be issued by an insurance company or companies admitted and licensed by the Insurance Commissioner to do business in the State of Washington. All costs associated with demolition including permits, removals and obtaining and abiding by all permits is the responsibility of Gase/Nichols Properties A copy of all permits will be provided to DNR. Hazardous Materials. Tests and Removals to be permitted and overseen by Gase Nichols An asbestos inspection turned up asbestos in the crawlspace under the building. There was no lead paint detected. The asbestos was removed by KDand S on Thursday, September 14 Bob Witheridge of Northwest Asbestos Consultants conducted a final inspection on September 19, 2006 and noted all asbestos was abated to meet ORCAA and EPA guidelines No lead was detected. A 300-500 gallon oil storage tank onsite was recommended to be left out of this demolition process by city staff due to extended review needs It was agreed by City, DNR and Gase Nichols that the tank would remain and dialogue with the City would continue with DNR for coordinated treatment at a later date Demolition Demolition will be completed by an excavator, 2 dump trucks, and operators provided by Vision Builders — owner Craig Heckman. Gase /Nichols will be responsible for removing the building and all associated debris from the site This will also include breaking concrete around the foundation (primarily at the back of the building) into smaller chunks onsite and cutting pilings down to ground level. The pieces that fit with the character of the site may be left as there is other concrete that has been placed in the riprap dust east of the site. All conditions of the city and other agencies must be satisfied. Every effort will be made to protect trees in front of the building from damage due to equipment. The kiosk on the eastern boundary should be left. The Chamber of Commerce will provide a crew of up to 10 to pick up materials on site that were left by the excavator They will be signed up as volunteers of DNR on a DNR volunteer sign up form. Nothing is to go into the water If it does, it needs to be retrieved immediately Pilings will be trimmed down to ground level. Waste Disposal All debris will be removed from the site Debris will be put into dump trucks and hauled to the Port Angeles Landfill. All debris not picked up by the excavator will be gathered by a volunteer group from the Chamber of Commerce on October 4, 2006 They will be covered under a volunteer agreement with the DNR. Safety The city has required a signing plan and flagpersons during the demolition. The signage plan and conditions are attached. Licensee will be responsible for the flag people and signage Fence Gase Nichols will install a temporary fence to protect the edge between the street and the foundation of the building. The City will install a more permanent fence after demolition is completed. The city has directed that the site be left unfilled after demoltion until such time as an inspection of the base and plan for the future are developed. A sign and flagging plan provided by the City will be followed. Flaggers will be provided by Gase/Nichols Costs of Removal This is a cooperative effort between the DNR, City, and Port Angeles Chamber of Commerce Gase Nichols are covering costs with matching funds up to $5,000 from the Port Angeles Chamber of Commerce Vision Builders is providing an excavator, 2 dump trucks, and operators with the agreement that Gase Nichols cover the costs The City has waived permit fees and landfill fees DNR waived application fees, paid $297 for disposal of PCB laden light ballasts at the Port Townsend landfill, and are providing right of entry to the property Gase Nichols has coordinated all the permits, equipment, directing work for a clean up crew from the Chamber, and is hiring two traffic flaggers on the day of excavation. The Chamber is coordinating volunteer labor for cleanup on October 4 and all will be signing up as DNR volunteers for that day Steve Zenovic and Zenovic and Associates have assisted in coordinating asbestos inspection and removal. The pink building on the waterfront is due to be demolished late this month or early August. It is in the public interest that the building be demolished and there is no private gain to the action although private monies are involved in the demolition. The persons financially responsible for the demolition, Jerry Nickels and Dan Gase, have asked that the landfill fees be waived under these circumstances. As to Item 1 above, I am enclosing a ROW application because I don't think anyone from your office or Vision Builders has picked one up yet. You were going to work with the appropriate parties in completing Item 2, and I have included a building permit application ' for your submittal. As to Item 3, you were to send a letter describing the proposed activity for review as to permitting issues. Although you didn't specifically mention this in your letter, it is assumed that the July 11 letter is a request for exemption from shoreline permitting requirements We will consider it as such unless I heat differently from you, and the determination will be that the activity is exempt from shoreline substantial development permitting because it does not meet the definition of a development within the shoreline" No further shoreline permitting is then required. I think we all agree, due to the poor condition of the building, the removal will be an improvement to the appearance of the waterfront. We have arranged for Vision Builders to be the contractor that will do the demolition. They are fairly available on short notice, so as soon as we have the various permits and instructions from the City of Port Angeles and the D.N.R. we will be ready to proceed. Vision Builders suggested that they should be able to do removal in one day so except for a little work in tidying up the site, we should be able to complete the project rather quickly The process that is planned, is to place a large excavator on the street side of building, and pick up and pull the structure toward the street. It will be loaded into trucks and hauled to the City's land fill. The estimated volume has already been reserved at the land fill. The north side rip rap will be protected by a silt fence to catch any small pieces that might fall Our contractor is pretty confident that nothing will go in that direction, but the fence will be an added precaution. Additionally volunteers from the Port Angeles Regional Chamber of Commerce will be on hand to pick up any small pieces of debris that may fall any place around the site. There are a number of items that are a matter of coordination and complying with what is expected by the City and D.N.R. I have discussed some of the items I have questions about with the parties, and we are available to finalize the plans for the project. This is kind of an over view and status report, and if any one has any questions, suggestions, or comments, please let us know We are impressed with the interest and cooperation from people at the D.N.R. the City of Port Angeles, the Chamber of Commerce and Vision Builders.
