Nathan West, Director Community & Economic Development Subject: Minor Deviation— 1512 Aurora Court A minor deviation of the minimum 25' front yard setback for a new residential structure in the RS-9 Residential Single Family zone is hereby approved to 23' Additionally, a reduction of the south side yard from 8' to 7' is also approved. This decision is supported by the following findings and conclusions. Findings. 1 The Port Angeles Municipal Code provides that, per Section 17 94 180, a minor deviation from a front, side or rear yard setback, lot coverage, and height requirements may be issued under certain circumstances. Minor Deviations of the Port Angeles Municipal Code require that findings be made such that: 1 The granting of the minor deviation is consistent with the purpose of the zone in which the property is located and the project is otherwise consistent with the requirements of said zone 2 Because of special circumstance, the strict application of the zoning ordinance results in an undue hardship upon the applicant. 3 The minor deviation will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and zone in which the subject property is located, and 4 The minor deviation is not greater than 10% of the requirement being deviated from. 5 The site must be posted and adjacent property owners notified fifteen (15) days prior to approval of the minor deviation. Applications that are not granted a minor deviation must obtain a variance through the City's normal variance procedure as set forth in Chapter 2 52 PAMC 2. Property owner Dan Mason applied for a building permit to construct a new single family residence at 1512 Aurora Court in the RS-9 Residential Single Family zone The site is accessed through the radius of a cul de sac and is unusual in shape A 10' utility easement is designated along the entire north side property line Minor Deviation—Mason 1512 Aurora Court Page 2 3 The property owner completed his structural planning without observation of the extra side yard setback. A building permit (09-1193) was issued but expired without work being done When it was renewed for a 6 month period, it was noted that the front yard setback was not measured from the property line. The property owner moved the footprint within the lot to be within 2 feet of the required front yard setback and 1 foot of the south side setback line and asked for a minor deviation to allow continuation of the construction. 4 The property seller and surrounding property owner is Frank Cavannaugh who provided support for the minor deviation in writing on May 11, 2010 5 Resulting setbacks are proposed to be 23' front, 7' on the south side, 15' on the north side, and a rear yard that varies from 17' to approximately 30' due to the rear lot configuration. Conclusion. 1 The minor deviation does not permit ,a structure to be larger than other structures within the subdivision in which the property is located nor to encroach or negatively affect any structure in the area. The cul de sac lot configuration requires particular attention to setback requirements that are further restricted by a 10' utility easement along the north side line. The ultimate configuration provides the desired depth at the front of the garage to the property line to allow a full sized vehicle to park within the driveway off the street but does not cause any irregularities that should affect neighboring property owners. 2. The minor deviation request will allow for the development of a structure that meets the intent of the RS-9 Zone and complements other development in the subdivision and general area. 3 The minor deviation was processed and meets the criteria established by 17 94 180 PAMC for rev ew and action on a minor deviation request.
