RE. Construction within Milwaukee Heights utility easement

It has been brought to our attention that the utility easements adjacent to lots 4 and 5 Milwukee Heights has building
and retaining wall encroachment.
The utility easements as shown on the Milwaukee Height Subdivision plat are 12.5 feet on either side of the common
4/5 lot line. The existing utilities lymg within this easement are water sanitary sewer and storm drainage mains.
The 607 Milwaukee Drive single family residence constructed in 1997 appears to encroach approximately 4 feet
into the utility easement along with a storage shed. The 609 Milwaukee Dnve single family residence recently
constructed appears to encroach approximately 0.5 feet into the utility easement along with A.C. unit. It also
appears that a 2-4 foot tall concrete retaining wall has been recently constructed between the 2 properties.
These structural encroachments within the utility easement should not have been allowed. This letter is to put the
property owner(s) of 607 and 609 Milwaukee Drive on notice that should a problem or an
emergency arise accessing the facilities within this corridor the City has the nght of ingress and egress to and over
the premises for repair or maintenance of the facilities and due to the nature of the encroachment any costs for
restoration of the encroachment would be at the property owners expense. In addition any damage to the utilities
arising from the encroachments will be repaired at the property owners expense.
Per the Port Angeles Municipal Code 14.01.050 Construction Near City Utilities and Easements. No new
construction or remodeling of existing structures shall encroach upon or interfere with City utilities or easements,
either above ground or below the ground, nor shall such construction violate applicable construction codes. Any
cost incurred by the City in modifying or relocating utilities brought about by such construction, except for an
increase in service, shall be payable to the City by the owner of the property on which such construction takes place.
