Hyden, granting the City of Port Angeles an easement for the construction of the Olypmic Discovery Trail. This easement is dated May 23, 1985. John S. Hyden died in March of 1998, and the property was inherited by my husband and myself. On several occasions I have requested that this easement be declared null and void as the plans were changed for the route of the trail. In fact, this portion of the trail has now been completed via Milwaukee Drive. Please advise me of the status of this easement and if I need to pursue any further action in this matter. Hyden, in consideration and as a condition of an Open Space Classification, OS -85 -1, received from the Grantee, the City of Port Angeles, does hereby grant and convey to said Grantee and its successors and assigns an easement for the purpose of access by the general public for a pedestrian hiking trail and recreation related thereto, which easement and access shall be over and across the following described real property situated in Clallam County, Washington: All that portion Northerly of a line fifteen (15) feet parallel to and south of the upland bluff edge of Suburban Lot 86, except the east three hundred (300) feet thereof; Townsite of Port Angeles. THE GRANTOR hereby releases all claims for damages against the Grantee incidental to the proper exercise of the rights herein granted; provided, however, that Grantee shall be liable for its own negligence in the exercise of the rights herein granted.
