Lastly, the. Strait.Muszc use in the southwest corner of.the building is figured at a -retail ratio of 1 300 and requires 10 spaces for the; use. My understanding is that if a building is out of compliance with parking requirements it must be red tagged for no occupancy after reasonable notice. My understanding also is that every violation of the building regulations may constitute a nuisance. Further, if one business is allowed to have less than the required number of parking spaces, it may be difficult for the City to enforce the parking space requirements for other businesses because the City may be establishing a de facto policy of substandard parking. My client would like to know when the appropriate notices will be sent to El Amigo and any other businesses not complying with the parking regulations by having the minimum number of required spaces. If, in fact, El Amigo does have a sufficient number of parking spaces, please let me know. We do not want to have to bear the expense of filing a nuisance suit ourselves. I hope to hear from you at your earliest convenience.
