HomeMy WebLinkAbout000501 Original ContractCity of Port Angeles Record #000501 City of Port Angeles City Manager Cellular Telephone (Smart Phone) Agreement to Withhold Funds THIS AGREEMENT is made and entered into this w4-- day of Se c a by and between the City of Port Angeles, acting thro gh its Human Resource Manager, herein referred to as the City, and the City Manager, herein after referred to as the employee. WHEREAS, the City has determined the use of cellular telephones (smart phones) is necessary to more efficiently conduct routine business as well as maintain communications during significant events. WHEREAS, the employee is expected to be accessible to the City Council and to senior staff, 24 -hours a day /7 days a week. WHEREAS, allowing personal use of the City -owned cellular telephones will provide the City the ability to require the employee to carry a cellular telephone and be reasonably available at all times. WHEREAS, the parties acknowledge the City is responsible for fees for "base" contract fees and the employee has the responsibility to pay the total cost of calls exceeding the "base" contract rate, with the City becoming obligated to make such payments should the employee fail to do so; and WHEREAS, it is necessary the employee give permission to the City to deduct from his /her paycheck any amount which the City becomes obligated to pay to the service provider due to the employee's failure to make the above payment; IT IS HEREBY AGREED BETWEEN THE PARTIES; 1. The Agreement shall begin on A 4-- 4 l 2-- and shall automatically renew unless terminated acco t 1ng to the provisions herein. 2. The City shall pay the employee- issued cellular telephone monthly base contract rate, and in the event monthly charges exceed the base rate, the employee will pay for all costs exceeding the base rate. The charge owed by the employee shall be reconciled and paid to the City no less than annually. The employee grants his /her consent to the City to withhold from any paycheck due to them the amount the City is obligated to pay the service provider on account of the employee's failure to make timely payments for the amount that exceeds the base contract rate. The employee shall fully indemnify, release and hold harmless, the City from any monetary costs or claims of any nature arising out of the personal use of a City owned cellular telephone. 4.
